For approximately ten (10) years, Brant had performed services for Morgan pursuant to a series of contracts. Following a dispute between the parties, Brant had filed a small claims action demanding payment for services. When Morgan then refused to further utilize Brants services, Brant brought suit, alleging that his termination was a wrongful retaliatory discharge. At trial, the jury was not required to determine whether Brant was an employee or an independent contractor, and awarded compensatory and punitive damages to Brant.
